Two Major Legal Initiatives on Mental Privacy & Biometric Data

March 7, 2025 Posted by Director Brains & Biometrics, Progress & Principles

Projects are currently underway to inform laws and principles governing biometric data and neural data, shaping the future of privacy in the evolving landscape of technology and AI.

The Uniform Law Commission Study Committee is focused on U.S. domestic states laws.
The Uniform Law Commission Study Committee on Mental Privacy: in response to new and amended laws in the US to address mental privacy and “neural data” this committee is evaluating the need for a unified state law in the U.S. to safeguard mental privacy and govern neural data collection, including from brain-computer interfaces and cognitive biometrics
Experts, industry professionals, and advocacy groups can participate as observers, contributing insights to discussions.

The American Law Institute–European Law Institute (ELI) Joint Project: Emphasizing principles-based governance with a broader international scope covering the full range of biometric technologies and their applications. The American Law Institute–European Law Institute (ELI) Principles for the Governance of Biometrics: this is the second joint project of the American Law Institute and European Law Institute, to establish principles for governing responsible biometric data use, including facial recognition, DNA, whether for identification or inferences about individuals across various jurisdictions like the U.S., Europe, and the UK.
Scope: Defining key terms, assessing benefits and risks, and addressing regulatory gaps and principles for alignment
Outcome: A diverse team of legal, technical, and ethics experts will formulate broad standards for policymakers globally, fostering responsible biometric data practices.
The project will openly share its outcomes, encouraging global stakeholders to provide feedback and embrace best practices.
