Beyond neural data: Cognitive biometrics and mental privacy

The paper by Patrick Magee , Marcello Ienca , and Nita Farahany  highlights how AI-powered devices (e.g., wearables, BCI’s) process a new class of data called ‘cognitive biometrics‘, raising unprecedented mental privacy concerns. In alignment with the upcoming UNESCO recommendation and Council of Europe report, the authors call for broader legal protections and responsible innovation standards beyond just neural data protection.

The authors urge a paradigm shift from measurement-focused to inference-focused regulation to properly protect Human Rights. This paper outlines the logic and practical application of this paradigm shift.
